ARTICLE 1 IDENTIFICATION
ARTICLE 2 ORDERS & OFFER
Agreements are validly formed after a valid payment has been effected through the web shop's payment platform, or by sending an e-mail confirming an order. If a customer places an order, this means that he explicitly agrees to abide by these conditions, including all statements and components such as the Privacy Statement and the return policy.
The Vendor has done all in its power to ensure that all the product information, colours, details and descriptions of the items are as accurate as possible. However, please note that images and colour quality may vary depending on the screen on which they are viewed. The Vendor cannot guarantee that a screen is able to reproduce all features of the actual product correctly. Each product is accompanied by a product description (colour, size, type of product, etc.) and truthful photographs.
The offer of Tutu Chic on its website is valid as long as stocks last.
The Vendor cannot guarantee a total absence of any errors in the web shop. The information that appears on the website may contain typographic and other errors concerning products, prices and items in stock. The Vendor cannot be held liable for the consequences of any such errors. The Vendor is entitled to correct any errors or inaccuracies in the web shop without being obliged to provide any kind of prior communication in this connection. If prices, discount, product information, etc. are not reproduced correctly on the website, or if these have been incorrectly incorporated into the invoice, the Vendor likewise reserves the right to amend or cancel an order free of charge.
ARTICLE 3 PRICE
The prices stated apply to each individual item and include 21% VAT. Prices do not include postage and packaging charges.
ARTICLE 4 PAYMENTS
After the Purchaser has placed an order, he will be redirected to a secure payment and will be requested to effect payment for his purchase.
You can pay by Bancontact, MisterCash, VISA, iDEAL or PayPal. You will receive confirmation of your order by e-mail as soon as payment has been effected.
ARTICLE 5 RIGHT OF WITHDRAWAL
Customer has the right to cancel the Agreement without stating reasons during 14 days, not for sale products. This term commences at the time at which Customer has received the entire order from Tutu Chic.
Returns are accepted only if they meet the following conditions:
- The consignment should be appropriately postaged and should contain a label with your return address.
- The items must be sent back in the original packaging. The packaging should be complete and intact.
- Articles must be undamaged and show no signs of being used. All articles will be thoroughly inspected when we receive them.
The refund will include the purchase price, not the shipping costs. You will receive the refund within 14 days after receiving the returned items. It is also possible to choose another item on our webshop of the same value as the returned item or a gift card for the amount of the purchase price instead of the refund. Additional shipping costs for returning the item to te Vendor are for your account.
ARTICLE 6 RETURN POLICY
Your order can always be exchanged when you didn't get the right size. Just make sure that the item is undamaged and hasn't been worn. An item can only be exchanged for as long as the stock extends. Sale items can only be exchanged for a different item or a giftcard.

If your order is delivered damaged, we ask you to notify us as soon as possible. This should be reported to the customer service, at the latest within 48 hours after delivery.
ARTICLE 7 FORCE MAJEURE
Tutu Chic is not liable, if and insofar as its obligations cannot be met as a result of force majeure.
Force majeure is understood to be each strange cause, as well as every circumstance, which in fairness doesn’t belong to come before it’s risk. Delay in or default by our suppliers, failures in the Internet, disturbances in the electricity, failures in email traffic and disturbances or changes in technology supplied by third parties, transport difficulties, strikes, Government measures, delays in landing, omissions of suppliers and/or manufacturers of Tutu Chic and auxiliaries, illness of personnel, flaws in aid or transport resources expressly apply as force majeure.
Tutu Chic reserves the right in the case of force majeure to suspend its obligations and is also entitled to terminate the contract in whole or in part, or to claim that the content of the agreement is amended in such a way that implementation remains possible. In no event shall Tutu Chic be held to pay any fine or compensation.
If Tutu Chic has already partially delivered upon its obligations following from the agreement at the point in time when a case of force majeure comes into existence, or if Tutu Chic is only able to perform a part of its obligations due to a case of force majeure, Tutu Chic retains the right to invoice the partial delivery and the client is obliged to treat this partial delivery as a separate and valid contract. This implies that the client is obliged to fulfill the payment of the partial delivery. This clause is not in effect if the partial delivery holds no significant value in itself.
Retention of title:
Tutu Chic remains the sole owner of the delivered product until the moment the sale price is fully met.
If you place an order at Tutu Chic, then your information will be included in the customers file of Tutu Chic. Tutu Chic abides by the law and will not provide your data to third parties.
Tutu Chic respects the privacy of the users of the internet site and shall ensure a confidential treatment of your personal data. Your email address could be used in a mailing organized by Tutu Chic. Each mailing contains instructions to remove yourself from this list.
